Ética profesional y Derecho: una investigación documental para comprender su alcance

Resumen

Este artículo tiene por objeto explorar la literatura sobre ética profesional en el Derecho. La investigación se desarrolla en un doble plano, uno descriptivo y otro analítico, con el propósito de ofrecer un panorama sobre cómo se entiende la ética profesional en este ámbito; esto es, las diferentes aproximaciones y preocupaciones de quienes reflexionan al respecto. Este ejercicio, a su vez, se orienta hacia una propuesta normativa sobre el entendimiento de la ética profesional en el derecho y su puesta en acción en los ámbitos del aprendizaje y del desempeño de las profesiones jurídicas. Para ello, se utiliza un método mixto, a través del cual se seleccionan y analizan los trabajos resultantes de la búsqueda en las bases de datos de Google Académico y de Mendeley. El trabajo está dividido en cinco apartados: en la primera parte se presenta el marco teórico de aproximación a la ética y a la ética profesional en el Derecho; en la segunda, se explica la metodología seguida; en la tercera, se muestran los resultados; en la cuarta parte se discuten los resultados; y, finalmente, en la quinta parte se proponen algunas líneas de investigación respecto a la ética profesional en el Derecho.
