Abstract

This paper provides an overview of the evolution of constitutional law, giving meaning to the changes in the concept of constitution as compared to the changes in content, the renewal of the theories and the reassessment of their roles. Then, the article studies the process of constitutionalization of the family in Europe and Latin America, citing related texts and characterizing it in general terms. The paper further evaluates the regulation of the institution of Human Rights in International Law and the impact of the jurisprudence of supranational bodies of justice of both regions in the creation of the ius commune familiar.
