Sentença Citizens United versus Federal Election Commission: corrupção e direito ao voto nos Estados Unidos

Resumo

Neste artigo, a sentença Cidadãos Unidos versus a Comissão de Eleições Federais (Citizens United v. Federal Election Commission), proferida pela Suprema Corte dos Estados Unidos da América em 2010, é estudada como um mecanismo para legalizar a influência irrestrita do financiamento privado na política americana. Levanta-se a hipótese de que essa modificação institucional, por sua vez, legaliza uma forma de corrupção política que é evidenciada na atual legislação de voto restritivo. Para dar seguimento ao estudo proposto, é apresentado um quadro referencial no qual são definidos os conceitos que articulam a análise. Em seguida, no desenvolvimento do artigo, são descritos os antecedentes e o contexto da sentença, para então passar a analisar duas de suas consequências: a primera é a influência do black money (doações anônimas) tanto nas campanhas quanto na seleção dos juízes, e a segunda é a exposição da influência do financiamento privado ilimitado das campanhas na legislação eleitoral restritiva em vigor.
